D'DECORATIONS FLOWER SHOP
Our promise to you: D’Decorations Flower Shop Company will provide all the services specified in client’s proposal for their event and work with client if any adjustments need to be made.
Deposit: To save your date, you must pay the 10% or the full amount. The deposit in non-refundable and is deducted from the total price of EVENT. Payment may be made with a credit or debit card.
Balance due must be paid in full 25 days prior to EVENT. If payment of balance due is not made, flowers and decor will not be ordered, and will be closed at the determination of D'Decorations Flower Shop. If D'Decorations Flower Shop determines your event can still be fulfilled after this date and CLIENT wishes to continue, there will be a 10% fee added to the balance due and an additional 10% fee for each 7 days that the balance is late. Any extraordinary costs incurred due to the late payment will be passed on to CLIENT.
Additions less than 25 days prior to EVENT will be accepted up to 7 days prior to EVENT and must be paid within 24 hours. No guarantee is given that the same flowers will be available, and pricing will be determined according to what is available. Color and style will be matched as closely as possible.
Cancellations: CLIENT understands this is a custom order and if payment is not made in full, any vendor obligations are canceled, and all payments are forfeited. Cancellations made less than 2 weeks before EVENT will forfeit full payment up to guaranteed minimum stated below. Any reimbursements will be received minus the transaction cost.
Substitutions: D'Decorations Flower Shop reserves the right to make substitutions in the event the flowers or decor received are not of the quality suitable to EVENT. The integrity of the proposed look and color scheme will be maintained, and flowers of equivalent value will be used. D'Decorations Flower Shop will inform CLIENT if a dyed flower is being used and will not be held liable for staining to any garments due to their usage.
Rental: All rental items must be returned in the same condition to COMPANY within 48 hours of EVENT. Any rental items returned later than 48 hours will incur an additional fee for the agreed upon rental cost of the items as stated in the original proposal. If the rental items are un-returned within 7 days or broken, the credit card of CLIENT will be charged for the full replacement cost.
All décor must be communicated to D'Decorations Flower Shop to preserve the consistency of EVENT. Any décor for the EVENT not provided by D'Decorations Flower Shop is not be guaranteed by D'Decorations Flower Shop even in cases where D'Decorations Flower Shop items are integrated. In such cases, any alterations deemed necessary will be made to preserve consistency and D'Decorations Flower Shop will be blameless.
Venue and Location Limitations: D'Decorations Flower Shop is limited by the rules and guidelines of the location(s) and site management. Negotiation with the officials for moderation of guidelines is the responsibility of CLIENT; D'Decorations Flower SHop will offer technical recommendations only. Reimbursements will not be made for unused items due to venue limitations not communicated to D'Decorations Flower Shop.
Terms: At the time of the initial deposit, adjustments can still be made to the invoice. Large additions and subtractions are accepted up until the balance is paid in full.
D'Decorations Flower Shop reserves the right to cancel this contract if at any time D'Decorations Flower Shop feels that the obligations cannot be met. D'Decorations Flower Shop will refund all money, including deposit if D'Decorations Flower Shop cannot fulfill obligations. CLIENT will be advised 30 days before event. In the event of fire, natural disaster, tragedy, or other emergency, D'Decorations Flower Shop will credit the amount toward another day minus any actual costs incurred up to that point that CLIENT informs D'Decorations Flower Shop.
Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules [including the Optional Rules for Emergency Measures of Protection]. The arbitration hearing shall take place in Brownsville, Texas before a single arbitrator. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
